This letter serves as an official demand for the immediate payment of the Pandemic Unemployment Assistance (PUA) back pay rightfully awarded to me by the Employment Development Department (EDD). The gravity of this issue cannot be overstated, as it involves significant financial and emotional distress caused by the EDD's negligence, incompetence, and acts of fraud. I have been wrongfully denied the benefits that I was promised and approved for by the Employment Development Department (EDD), and I have suffered significant financial and emotional distress as a result of the Employment Development Department (EDD)’s negligence, incompetence and acts of fraud. As a small business owner, my eligibility for PUA benefits was initially restricted, as the laws governing the program excluded business owners. However, in recognition of the unique challenges faced by small business proprietors, the laws underwent changes, allowing individuals in my position to rightfully claim PUA benefits¹. The EDD, through its website, clearly outlined the PUA benefits, spanning up to 86 weeks between February 2, 2020, and September 4, 2021². In December 2020, I received a notice in the mail from the EDD stating that I may be eligible for back Pandemic Unemployment Assistance (PUA) pay and it directed me to upload my 2019 tax returns. I complied with this request and uploaded the 2019 tax returns as instructed. In January 2021, I received an Award Letter from the EDD for close to $30,000 in back Pandemic Unemployment Assistance (PUA) pay, laying out the weeks I had been paid vs. the weeks I had not, and the weekly amounts. This letter clearly stated that nothing further was needed from me. However, subsequent attempts to receive the promised benefits were met with a series of unexplained delays, misinformation, and unprofessional conduct from EDD representatives. Despite complying with additional requests to upload 2020 tax returns and certify for weeks, the promised funds never materialized. Finally, in June 2021, I got in touch with someone. They took my name and all my info and looked into my account. When doing so, they obviously saw what I had told them about the Award Letter. They told me I needed to upload another year's taxes, 2020. Once done, then certify for the weeks (stating clearly that this would happen and I would receive the funds to my EDD Bank of America Debit card in 10 days). Even though the Award Letter clearly stated that no further action was needed on my part. Begrudgingly, I uploaded the 2020 taxes and waited for the certifications for the weeks, which never came in. I continued to check my EDD account and I did not receive the funds either. I called the EDD repeatedly, until I was finally connected. This time, they connected me to a new department. I told the woman what was happening and within minutes she blatantly hung up on me. I was now forced to repeatedly keep calling back again. Finally, getting through, I got transferred over and over again. I was put on with a specific department that handles this. I spoke with the woman and she kept telling me that I was not owed anything, even though the Award Letter clearly showed the paid weeks and stated the amount of money owed to me and the reasoning why. The woman insisted that the Award Letter was incorrect. I clearly asked and stated that for two years I contacted the EDD and could not get through to talk to a real person and was hung up on by the answering machine telling me to call back. All because the EDD was understaffed and overwhelmed with the amount of people due to the pandemic. Two years, I could not get through. But she was telling me that the EDD had people sitting around creating letters to send notifying people that they may be eligible for back pay and asking them to send in taxes, then people sending Award Letters. Well, there is a lot more. Which would mean that the EDD, which was impossible to get in contact with for over two years, made the same mistake each step of the way. The litany of errors, contradictory statements, and unfulfilled promises from EDD personnel, as outlined in the detailed chronology below, raises serious concerns about the integrity of the process: Notification of potential eligibility and request to upload 2019 tax returns. Internal approval process for accurate communication of eligibility to claimants. Oversight of uploaded 2019 tax returns. Approval decision for PUA back pay. Creation of the Award Letter with specific details. Approval of the Award Letter content. Calculation of weeks and amount owed. Request for additional 2020 tax returns and assurance of payment within 10 days. Inconsistent information and unprofessional conduct during phone interactions. Failure to provide promised printout of weeks, missing crucial information. This sequence of events raises serious questions about the competence and honesty of the EDD and its employees. I couldn’t get in touch with the EDD for almost 2 years due to the overwhelming response and you want to tell me that each step listed above was work taking time and money to make that many mistakes, the same mistake The woman kept telling me that she was looking at my weeks and I was not eligible and continued to give me reasons that did not make any sense as I was looking at the online portal myself and I was reading the Bill for the PUA I was being lied to. I am a very intelligent man and was being treated as if I was a simpleton that would just roll ever and listen to what I was being told even though what it was compared to what I had seen and what I had received didn’t line up. Finally she told me she was going to send me a print out of the weeks so I could specifically see which payouts came from the state of CA, EDD of what Federal Program like EDD then she hung up on me mid sentence. I received this print out (months later, after the final date to try to collect the Award - How convenient of the EDD) It was exactly what I could see online but it was missing one column on it. The same specific column that was the one and only reasoning for sending me the print out. The column list which program the payouts were from. I received a letter from the EDD stating that I was eligible for the PUA back pay and asking me to upload my 2019 tax returns as proof of income. I uploaded my 2019 tax returns as requested, and I expected that the EDD would process them and issue the payment promptly. I received an Award letter from the EDD, confirming that I was approved for the PUA back pay and stating the amount of weeks and total dollar amount owed to me. I called the EDD to inquire about the status of the payment, and I spoke with a man who told me that they needed another year’s tax returns, 2020, and that I needed to certify for the weeks after they received my tax return. He assured me that I would receive the payment within 10 days. I uploaded my 2020 tax returns and certified for the weeks as instructed, and I waited for the payment to be deposited into my Bank of America EDD account. I called the EDD again to check on the payment, and I spoke with a woman who hung up on me after asking a few questions. I called the EDD once more, and I spoke with another woman who sat on the phone for over an hour, telling me that it was all a mistake and that I was not eligible for the PUA back pay. She contradicted everything that I had been told and shown by the EDD, and she gave me reasons that did not make any sense. She said that she was looking at my weeks and that I was not eligible, even though I was looking at the online portal myself and I was reading the Bill for the PUA. She lied to me and treated me as if I was a simpleton who would just accept what she said without question. She then said that she would send me a printout of the weeks so that I could see which payouts came from the state of CA, EDD or what federal program like EDD, and then she hung up on me mid-sentence. I received the printout that she promised, but it was missing the column that listed which program the payouts were from. This was the same column that was the one and only reason for sending me the printout in the first place. All of this is a scam. The EDD is trying to save money by denying me the benefits that I rightfully deserve. I watch the news and I know how much of a deficit the EDD is facing and how many lawsuits there are against the EDD for things like this and for fraud. The EDD has acted with clear intent to cause harm by illegally withholding my insurance money that was meant to help me survive in a time of crisis. The blatant lies and behavior of the EDD employees show the malice behind the intent. The entire scenario indicates a clear violation of my rights and a case of fraud by the EDD and its employees. This not only gives me the right to sue for compensation, but also exposes the EDD to punitive damages, which in the state of CA can be up to 10 times the compensation, which is what has happened here.
I assert my right to pursue legal action against the EDD for compensation, supported by the violation of my rights and the clear intent to cause harm by withholding entitled insurance funds. The malice displayed by EDD employees further justifies punitive damages, which can be substantial under California law. I hereby demand the immediate payment of the full PUA back pay, along with interest, deposited into my Bank of America EDD account due upon receipt of this letter. Failure to comply will result in the initiation of a lawsuit, seeking all available legal remedies.
